El privilegio del agricultor a la luz de la interpretación prejudicial del Tribunal de Justicia de la Comunidad Andina de 6 de noviembre de 2023 en el proceso 384-IP-2019

RESUMEN: En el presente capítulo se analiza el art. 26 de la Decisión núm. 345 de la Comisión de la Comunidad Andina, a la luz de la reciente Interpretación Prejudicial del Tribunal de Justicia de la Comunidad Andina de 6 de noviembre de 2023 en el proceso 384-IP-2019, centrando la atención en los problemas interpretativos y de encaje legal que suscitan. Se espera que el análisis y sugerencias ofrecidos contribuyan a la mejor interpretación y regulación de esta cuestión en el ámbito de la Comunidad Andina, en pro de la sostenibilidad regional del sistema de derechos de obtención y de la innovación agraria.

ABSTRACT: This chapter discusses Art. 26 of Decision No. 345 of the Commission of the Andean Community, in the light of the recent Prejudicial Interpretation of the Court of Justice of the Andean Community of November 6, 2023 in the case 384-IP-2019, focusing on the interpretative problems and of legal fit that they raise. It is hoped that the analysis and suggestions offered can contribute to better interpret and regulate this matter in the Andean Community in favour of the regional viability of the plant breeders’ rights system and of agricultural innovation.
